General Terms of Sale

01

Object

These general terms and conditions of sale detail the rights and obligations of Anne KRIEG (hereinafter referred to as "the supplier") and her client. Any sale carried out by the supplier therefore implies the client's unreserved acceptance of these general terms and conditions of sale. Any general terms and conditions of purchase belonging to our clients shall not be enforceable against us.

Should any clause within these general terms and conditions be found to be void or otherwise invalidated, the remaining clauses shall nonetheless remain in full force and effect. The fact that the supplier may, at any given time, refrain from enforcing any clause of these general terms and conditions shall not be construed as a waiver of the right to invoke said general terms and conditions of sale at a later date.

02

Application

These terms and conditions apply to all sales to private individuals via the website annekrieg.com—within the countries for which specific rules and costs are defined on the site—as well as to any other sales made to private individuals by the company "Anne Krieg Céramique," whether at the studio, at a trade show or market, or through any other channel.

03

Order

Orders must be placed via the website www.annekrieg.com, or submitted in writing—either by mail or electronically. To be valid, every order must include:

- The customer’s full name and a precise delivery address for the carrier.

- A mobile phone number and an email address for order tracking.

- Full payment for the merchandise and shipping costs, in accordance with the established terms.

An order confirmation, as described above, constitutes the customer’s unconditional acceptance of these general terms and conditions of sale.

04

Shipping time

The availability timeframe indicated at the time an order is placed is provided for guidance only. As a general rule, the processing time for items in stock is 3 days, to which must be added the transit time, which depends on the destination.

For products not in stock, the typical lead time is 10 to 20 weeks, depending on the quantity.

A delay in shipment shall not constitute grounds for terminating the sales contract, nor shall it give rise to the payment of damages, late-payment penalties, or order cancellation. The supplier reserves the right to make partial shipments.

05

Shipping

Shipment is carried out:

- either by sending a notification to the client that the item is available for collection at the workshop,

- or by delivery to the location specified by the client on the order form or quote.

06

Transport and receipt

For orders over €50, shipping is free within metropolitan France. In all other cases, shipping and insurance costs are the responsibility of the customer and are included in the total amount calculated on the website, based on the weight of the items and the destination country (provided it is a covered destination).

Goods are shipped in double-walled cardboard boxes.

The customer must inspect shipments upon arrival. In the event of missing or damaged items, the customer must send an email within 2 business days of receiving the shipment. This email must describe the issue and include photographs of the damaged items as well as all packaging (including any intact packaging, showing the shipping label and a legible barcode).

All items (damaged goods and packaging) must be kept as evidence for insurance purposes until the dispute is resolved.

07

Non-compliance

Any variations in color or dimensions do not constitute non-conformity; rather, they are a hallmark of artisanal production.

08

Return of goods

In the event of damage during transport, non-conformity, or an apparent defect, the return of goods may only take place with the supplier’s written consent and, in any case, no later than 10 days after receipt of said goods. Custom-made parts cannot be returned or accepted for return.

If a return is made, the supplier will only accept the goods back once the apparent defects or non-conformity have been verified. In such cases, the goods will be replaced. The costs for the return and subsequent re-delivery will be borne by the supplier.

Any return of goods that has not been approved in advance, or for which no apparent defects or non-conformity can be established, will be held at the client’s disposal; such items will not be eligible for replacement or the issuance of a credit note. In these instances, the return costs shall be borne by the client.

09

Price

The prices of the goods sold are those in effect on the date the order is placed. Prices are ex-works, in euros, and exclusive of taxes. VAT is not applicable, pursuant to Article 293B of the French General Tax Code (CGI). The supplier reserves the right to modify its prices at any time. However, the supplier undertakes to invoice the ordered goods at the prices indicated at the time the order is registered.

10

Payment terms

Orders are to be paid for in full via credit/debit card on the website; for all other orders, payment is to be made by bank transfer.

11

Intellectual property

The name "Anne KRIEG," as well as all illustrations, images, and logos, are the exclusive property of the supplier. Any reproduction—whether partial or total—modification, or use of the name, illustrations, images, or logos, for any purpose or via any medium whatsoever, without the express, prior, written consent of the supplier, is strictly prohibited.

12

"Force majeure"

13

Competent court

Any dispute relating to the interpretation or execution of these general terms and conditions of sale shall be governed by French law. In the absence of an amicable resolution, the dispute shall be brought before the Commercial Court of Toulouse (France).

The customer acknowledges having read these general terms and conditions of sale and accepts them without reservation.
